That Does Not Make Planning Optional.</h1><p style="font-family:Arial,sans-serif;font-size:20px;color:#506273;margin:0 0 24px;"><strong>Bottom line:</strong> A higher federal threshold may reduce one tax concern, but it does not solve ownership transfer, control, beneficiary and business-continuity risk.</p><p>The 2026 federal estate-tax number is large enough that many owners will assume the issue no longer touches them. That is the wrong lesson. Estate planning for a business owner is not only about federal estate tax.</p><p>The practical question is what happens to control, signing authority, bank access, payroll, customer relationships, leases, licenses and family expectations if the owner dies, becomes incapacitated or exits suddenly. A business can be under the federal estate-tax threshold and still be thrown into confusion by weak documents.</p><h2>What should be reviewed</h2><p>Start with the will, trust, power of attorney, health care proxy, operating agreement, buy-sell provisions, life insurance, beneficiary designations and authority records. Then compare those documents against the business reality. Who actually runs the company? Who can sign checks? Who can talk to the landlord, lender, processor and tax professional?</p><table style="width:100%;border-collapse:collapse;margin:22px 0;font-family:Arial,sans-serif;font-size:15px;"><tr style="background:#0b2438;color:white;"><th style="padding:10px;text-align:left;">Planning issue</th><th style="padding:10px;text-align:left;">Business consequence</th></tr><tr><td style="border:1px solid #d9e2ea;padding:10px;">No clear successor</td><td style="border:1px solid #d9e2ea;padding:10px;">Operations stall while family or partners argue authority.</td></tr><tr><td style="border:1px solid #d9e2ea;padding:10px;">Old beneficiary forms</td><td style="border:1px solid #d9e2ea;padding:10px;">Assets may move differently than the owner expects.</td></tr><tr><td style="border:1px solid #d9e2ea;padding:10px;">Unclear buy-sell terms</td><td style="border:1px solid #d9e2ea;padding:10px;">Valuation and control disputes become expensive.</td></tr></table><h2>The practical takeaway</h2><p>A bigger exemption can be helpful, but it should not lull owners into ignoring the documents that control daily business survival. Planning should answer a simple question: if the owner cannot act tomorrow, can the business still make payroll, serve customers and preserve value?</p><p style="margin:24px 0 0;"><strong>Related Craig resources:</strong> <a href="https://www.craigfinelawgroup.com/">The Law Office of Craig A.
